Job Description

Position: Litigation Attorney or Senior Litigation Attorney

Reports To: Legal Director

Wage Class: Exempt

Union Classification: Eligible

Location: Remote (with Massachusetts residency required)

 

Position Overview

The Litigation Attorney will advocate for the rights and interests of individuals with disabilities through representation in civil rights class action and impact litigation as well as other forms of systemic advocacy to protect and promote the rights of the disability community in Massachusetts. A Senior Litigation Attorney will have 10 or more years of legal practice.

 

Essential Functions:

  • Under the direction of the Legal Director:
    • Serve in a lead role in litigation and underlying investigations, including case development, legal strategy, factual research, legal research, site visits, and client development;
    • Represent clients in class action and other impact litigation, individually or as part of a team, through all stages of litigation, including written discovery, document review, taking and defending depositions, meeting and conferring with opposing counsel, motion practice, brief writing, in-court argument, client management, and appellate, trial, and monitoring work as needed; and
    • Negotiate settlements, including drafting mediation statements, term sheets, settlement agreements, and representing clients in negotiation sessions.
  • Conduct client outreach and cultivate and maintain relationships with disability professionals, advocates, and organizations.
  • Collaborate with other DLC staff in the development and implementation of systemic advocacy activities.
  • Attend in-person meetings with colleagues, clients, opposing parties, government officials, and others.
  • In accordance with DLC policies and procedures, maintain: the security of confidential information and records; complete and accurate records documenting advocacy, monitoring, and investigation activities and time spent.
  • Travel throughout Massachusetts to perform assigned job tasks.
  • As assigned, perform other duties required to support DLC’s mission.
 

Required Qualifications:

  • Juris Doctorate and ability to practice law in Massachusetts (current MA bar admission or immediate ability to be admitted to MA bar required).
  • 7+ years of legal practice experience, with at least 5 years of litigation or equivalent experience. Preference for class action and/or civil rights experience, though all litigation experience will be considered.
  • High quality legal writing and in-court/negotiation advocacy skills.
  • Professionalism and sound ethical judgment.
  • Strong initiative, efficient time management, follow-through, and flexibility around changing priorities and meeting deadlines.
  • Knowledge of legal principles and practices related to impact or class action litigation.
  • Demonstrated commitment to protecting and promoting the rights of historically marginalized groups, e.g., people with disabilities, people of color, LGBTQ+ people, people with low income, and incarcerated people.
  • Ability to work with diverse groups of individuals.
  • Ability to travel throughout Massachusetts.
 

Desired Attributes:

  • Ability to communicate effectively in a language other than English: ASL, Spanish, Haitian Creole, Portuguese, Mandarin, or another non-English language.


Compensation:  

Attorney salary is determined by a collectively bargained salary scale based upon years of experience. For example, on the scale, the salary of an Attorney with 7-8 years of experience is $78,200.
